Pochote Ocean Adventures
1. Terms & Conditions
By booking a tour with Pochote Ocean Adventures, you agree to the following:
- All tours are subject to availability, weather, and ocean conditions.
- The company reserves the right to modify, reschedule, or cancel any tour for safety or operational reasons.
- Guests must follow all instructions given by the captain or crew at all times.
- Pochote Ocean Adventures is not responsible for delays caused by weather, sea conditions, or circumstances beyond our control.
- Each participant is responsible for their personal belongings during the tour.
2. Booking & Payment Policy
- A 20% deposit is required to confirm any reservation.
- Reservations are not confirmed until the deposit has been received.
- The remaining balance must be paid on the day of the tour (cash or agreed payment method).
- If “Book Now & Pay Later” is selected, a payment link will be sent via email.
3. Cancellation & Refund Policy
- Deposits are non-refundable, except if the tour is canceled by the company.
- Cancellations made less than 48 hours prior to the scheduled tour are non-refundable.
- No-shows will be charged the full amount of the tour.
- In case of unsafe weather conditions, clients may reschedule or receive a refund of the deposit.
4. Liability
- All tours are undertaken at the participant’s own risk.
- Pochote Ocean Adventures maintains a valid third-party liability insurance policy for its boat tour operations.
- This policy provides coverage for third-party damages up to a maximum of ₡25,000,000, subject to the terms, conditions, exclusions, and limits established by the insurer.
- The policy includes an applicable deductible of ₡50,000.
- The company is not responsible for personal injuries, accidents, loss, or damage to personal belongings during the tour.
- By participating in the tour, guests agree to release the company from liability beyond the coverage established in the active insurance policy, except where required by law.
5. Insurance Policy
- Pochote Ocean Adventures holds a boat insurance policy with third-party liability coverage, issued by the National Insurance Institute (INS), valid during all tour operations.
- This insurance applies only to third-party damages and is subject to all policy terms, conditions, exclusions, and deductibles.
- The insurance does not include personal medical coverage, individual accident insurance, or coverage for guests’ personal belongings.
- Any claims will be handled in accordance with the insurer’s policies and procedures.
- Guests are strongly encouraged to obtain their own travel insurance covering medical expenses, accidents, cancellations, and unforeseen events.
6. Safety Policy
- Life jackets and safety equipment are available for all passengers.
- The captain has full authority over safety and navigation decisions.
- Tours may be modified or canceled if conditions are deemed unsafe.
7. Force Majeure
Pochote Ocean Adventures shall not be held responsible for cancellations, delays, or changes caused by events beyond our control, including but not limited to weather conditions, natural events, government restrictions, or other unforeseen circumstances.
